By subscribing to Amy's Flashcards or by receiving any services offered through this web site, you represent and warrant that you understand, agree to, and accept all terms and conditions contained in these terms.
A "subscriber", in the context of this document, is any family or group who pays the subscription fee for www.AmysFlashcards.com.
The "web site" or "this site", in the context of this document, refers to www.AmysFlashcards.com.
A "Guest" refers to a non-subscriber who uses the Amy's Flashcards web site.
The "Free Drills" refer to the drills that are available free of charge to guests (non-subscribers).
The owner refers to Steven M. Sobek. He is the owner of Amy's Flashcards web site which is part of Sobek's Services. The word, "company", refers to Amy's Flashcards/Sobek's Services.
A "student", in the context of this document, is any student who has enrolled in one of the online algebra classes or other classes that are available through the Amy's Flashcards web site. The word "parents" refers to the parents or guardians of an enrolled student.
An "Active Student" refers to a student whose parents have paid the full price for that semester which is currently $250/semester ($500 for the full year).
An "Auditing Student" refers to a student whose parents have paid the discounted price for that semester which is currently $175/semester ($350 for the full year).
A "Semester Elective Class" is a class offered through the Amy's Flashcard website that lasts for only one semester. These Elective classes may cover computer applications or other topics specified on the web site.
"The web site" and "this web site", in the context of this document, refers to www.AmysFlashcards.com.
"Teacher" refers to Steven M. Sobek. He is the owner of Amy's Flashcards web site which is part of Sobek's Services. The word, "company", refers to Amy's Flashcards/Sobek's Services. Mr. Sobek is the instructor for both the algebra 1 class and the algebra 2 class and other classes offered through this web site.
A "tutee" is someone who receives tutoring services through the Amy's Flashcards web site.
Subscribers will have full access to all of the flashcard-like drills and instructional videos on the web site.
The subscription fee does not cover the cost of the online Algebra classes that are taught via webinar nor does it cover the cost of any future class made available through this web site. Those who do enroll in the classes offered through the Amy's Flashcard web site are automatically subscribers to Amy's Flashcards and have full access to all of the flashcard-like drills for the full duration of the class. Families who enroll their child in any of the classes fully understand and agree to the terms of service laid out in this document.
When a family or group subscribes, two transactions will take place:
A subscriber may cancel the subscription at any time. When the subscription is canceled, no further money will be deducted.
When a subscriber cancels the subscription, they will still have access to all of the drills and videos on the web site through the duration of the subscription period. At the end of that subscription period, the former subscriber will no longer have full access to all drills. They may continue to use the web site as a guest, which grants them only partial access to the drills.
The subscriber understands that the owner may alter, upgrade, or modify the web site at any time at his sole discretion.
Subscribers and guests both understand that the owner may change the free drills at any time at his sole discretion.
A family subscriber understands that the user-name and password are for that one family only and are not to be shared with any other family.
Group subscriptions are for local groups only. State-wide groups, national groups and international groups do not apply. Valid examples of local groups are shown below:

Group subscriptions cover all families that belong to that local group. The group user-name and password are not to be shared with anyone not belonging to that group.
The handouts/PDF files available on the web site are to enhance the experience of subscribers. They are to be used, as is, and may not be altered in any way. Users must not remove the copyright information on the document. They may be duplicated for family or classroom use only. They may not be posted for download on any other web site. All PDF maps, handouts and other resources available on Amy's Flashcards web site may be used for personal or classroom use provided you do not remove any trademark, copyright or other notice contained on such pages. No other use is permitted. You may not, for example, re-sale the documents or make them available for download on any other web site.
All drills on the Amy's Flashcard web site are copyrighted and may not be duplicated on any other web site.
The subscriber understands that any service offered through the internet will have some interruptions. From time to time natural catastrophes, power outages, and general maintenance will render the web site unavailable for a period of time. The subscriber will not hold the owner liable for any such interruptions of service.
All disputes are to be held directly with the owner using the contact form on the web site. Settlements will never exceed the amount of money that the user paid to Amy's Flashcards.
The subscriber understands that the owner will not share the subscribers email address or other personal information with any third party. All information will remain confidential.
You may find links to other websites or resources on the Site. You acknowledge and agree that Amy's Flashcards is not responsible for the availability of such external sites or resources, and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. Amy's Flashcards will not be responsible or liable, directly or indirectly, for any actual or alleged damage or loss caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.
The subscriber and non-paying guests that use the Amy's Flashcards website understand that the owner will make every effort to keep the drills accurate. But sometimes cities, rivers and even countries change names. It is very difficult to keep every drill totally up to date. So the owner does not guarantee that all drills are completely accurate. The owner will not be held liable for any inaccuracy on the web site. The subscriber and non-paying guests understand that they may use the web site on an "as is" and "as available" basis without any statements or warranties of any kind regarding the completeness, reliability, quality, accuracy or availability of the services. Use of the site is at your sole risk unless otherwise explicitly stated. The site, including the information, services, and content, is provided on an "as is", "as available", and "with all faults" basis. Individuals who use the Amy's Flashcard website as non-paying guests will have only limited access to the flashcard-like drills and instructional videos. Drills and videos available to non-paying guests can be modified at any time without notice at the sole discretion of the owner of Amy's Flashcards. These guests who use the website without paying signify by their usage that they understand and agree to these terms of service.
Amy's Flashcards may provide notice to Subscribers, registered students and guests via email, regular mail, or posting notices or links to notices on the Site. Amy's Flashcards reserves the right at any time to modify the web site and/or the Terms of Service. Amy's Flashcards will not be liable to Subscribers, guests or any third-party for any modifications made. Amy's Flashcards may amend these Terms at any time by posting the amended terms on this Site.
An "active student" will be able to ask and respond to questions during a class session. This student may occasionally be asked to "go to the board" which means to be given presentation status so he/she can work through a problem for all to see and hear.
Students will need to activate their microphones when speaking. Activation of their webcam will always be optional. Some students enroll in these webinar classes not only to learn algebra, but also to interact and get to know other students in the class. Such students are more apt to use their webcam during a lesson. Webcam use will never be mandatory. Active students will only be required to use their microphones.
"Auditing students" enroll at a discounted rate and will gain access to the virtual classroom as observers only. Auditing students will see and hear everything that takes place. They will also be sent a hyperlink to the recording of all lessons so they will be able to playback any part of the lesson they desire just like active students. Auditing students should be working through all problems but they may not ask a question or respond to the teacher's questions. Although and auditing student may not "raise a hand" they will be able to signal the teacher with various icons such as "slow down" or "speed up." The teacher will monitor signals sent by all students and react as he deems is in the best interest of the class as a whole.
If a student is absent from a class, he/she should watch the recording of the class as soon as possible.
Clear audio signals are essential for a quality learning experience. For this reason both the teacher and the active students are strongly advised to use a USB headset (microphone and earphones). Students should also launch the audio wizard to help ensure proper levels are set for both speaking and listening. Training will be provided on the use of this wizard.
Students will need a computer with reliable internet connectivity. An average laptop computer should be fine. Active students should have a mouse for more accurate writing when called upon to work through a problem for all to see. Writing with a touch pad would be nearly illegible.
The teacher plans to progress through the material at an average pace, but pacing will be impacted to some measure by the feedback of active students.
Although there is no religious requirement for students to enroll, the teacher is a Christian and he will conduct the class just as he would teaching in a Christian school. Biblical standards of conduct will be used. Swearing or any other inappropriate language will not be tolerated. Students will behave respectfully at all times. It is OK to laugh with other students but not at other students. I desire to provide a safe atmosphere so students will feel free to make mistakes, knowing that they will not be ridiculed or put down when struggling with certain concepts. Students who choose to activate their webcam when called to the board must be dressed modestly as you would expect in a typical Christian school. It will not be deemed inappropriate to ask classmates to pray for them or for an ill family member. Such requests are welcome and would be best positioned at the end of class rather than during the lesson.
A student who repeatedly violates these standards of conduct may be temporarily or permanently demoted to audit status at the sole discretion of the teacher.
The parents and students understand that there may be days that the teacher is ill or has a family emergency or funeral to attend. On those days class will be cancelled. The class will be made up either on a Friday or at the end of the school year.
Vacation days around holidays like Christmas will be similar to the vacation days of public school students. Active students will be asked for their input regarding the duration of a vacation.
The video and audio of each class will be recorded. Hyperlinks to the recordings will be emailed to both active and auditing students so they may replay portions of a lesson that they wish to watch again.
The video recordings of the lessons are exclusively the property of the teacher, Steven M. Sobek. Parents understand that when they enroll their child in one of these algebra classes they (and their child) are granting permission for Mr. Sobek to record the class and use the videos however he chooses to. The primary purpose of the recording is to allow students to replay parts of the lesson to help their understanding of the concepts. The videos belong to Mr. Sobek and he may also use the videos as samples for prospective students or any other way he wishes.
The cost for an active student is $250 per semester. The first $50 is required to register for the class and is non-refundable. The balance of $200 is due no later than at the end of the first week of class.
The cost for an auditing student is $175 per semester. The first $50 is required to register for the class and is non-refundable. The balance of $125 is due no later than at the end of the first week of class.

If a parent chooses to withdraw their child during the first two weeks of class they will receive a full refund minus the $50 registration fee which is non-refundable.
No refunds are granted after the first two weeks of class.
The cost for a yearlong class or a semester class may change from year to year at the sole discretion of Amy's Flashcards. The current prices will be posted on the web site.
Tuition for the second semester is due by the end of the first week of the second semester. First semester students are automatically registered for the second semester. Only new students need to complete the registration form and pay the $50 registration fee (non-refundable). New students will only be accepted if there is room. The maximum class size will be about 20 active students. There is no limit to the number of auditing students.
Families will receive a 100 dollar refund if they refer another friend who enrolls as an active student in a yearlong class. This refund will be sent only after the referred student remains enrolled for at least one semester. When the referred student enrolls, he/she will be asked if someone referred them. As current students encourage others to register, remind them to list your name as the referring student.
If you refer two active students you will receive a $200 refund. The total amount of your refund may equal but can never exceed the amount of your tuition. So an active student in a yearlong class will never be refunded more than $500 dollars (referred five active students).
Families will receive a 50 dollar refund if they refer another friend who enrolls as an auditing student. This refund will be sent only after the referred student remains enrolled for at least one semester. The total amount of your refund may equal but can never exceed the amount of your tuition.
Absolutely no guarantee is made regarding SAT scores or the general success of the child enrolled in any of the classes offered through Amy's Flashcards web site.
Parents who enroll their child in any one of the online algebra classes or other elective classes made available through this web site understands and agrees to every aspect of the terms of service detailed in this document.
Users understand that a request for online tutoring may or may not be accepted. The teacher, Steve Sobek, can only fill a limited number of requests each week.
The fee for tutoring may change at any time at the sole discretion of Steven Sobek. The current fee will be posted on Amy's Flashcards web site.
Payment for tutoring services is to be paid within 24 hours after the end of the tutoring session.
Students who receive online tutoring through this web site will receive a complementary one year subscription to Amy's Flashcards.

The tutee understands that the owner will not share their email address or other personal information with any third party. All information will remain confidential.
Absolutely no guarantee is made regarding SAT scores or the general success of the child receiving the tutoring.
These classes have not been accredited by the Middle State Association or any other accreditation organization.
Parents who have their child tutored through this web site understands and agrees to every aspect of the terms of service detailed in this document.
Any controversy, claim, suit, injury or damage arising from or in any way related to the Site, its use, its Tutor conduct, or the Terms that cannot be settled directly with Steven Sobek, shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association then in effect and before a single arbitrator chosen by Amy's Flashcards. Any such controversy, claim, suit, injury or damage shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any controversy, claim, suit, injury or damage of any other party. The arbitration shall be conducted in Pittsburgh, Pennsylvania, and judgment of the arbitration award may be entered into any court having jurisdiction thereof. Amy's Flashcards may seek any interim or preliminary relief from a court of competent jurisdiction in Pittsburgh, Pennsylvania, necessary to protect its rights pending the completion of arbitration. Each party shall assume its own costs of arbitration.
You agree that any material breach of the Terms will result in irreparable harm to Amy's Flashcards for which damages would be an inadequate remedy and, therefore, in addition to its rights and remedies otherwise available at law, Amy's Flashcards will be entitled to equitable relief, including both a preliminary and permanent injunction, if such a breach occurs. You waive any requirement for the posting of a bond or other security if Amy's Flashcards seeks such an injunction.
This Agreement shall be governed by and construed in accordance with the substantive laws, without regard to choice of law rules, of the State of Pennsylvania.
Subscribers to Amy's Flashcards and those receiving any services provided on this web site, understands and agrees to every aspect of the terms of service detailed in this document.
